These Terms of Service (“Terms”) govern your use of theresidentialeye.com, operated by GJS Appraisal Services LLC (doing business as The Residential Eye, “we,” “us”). By accessing or using the website, you agree to be bound by these Terms. If you do not agree, do not use the website.

Use of the website

The website is provided for informational purposes and to allow you to request our services. You agree to provide accurate and complete information when submitting a service request, to use the website only for lawful purposes, and not to attempt to interfere with the website’s operation, security, or accessibility.

Service requests, quotes, and engagement

Submitting a service request through the website does not create a contractual engagement, a fee agreement, or any obligation on our part to perform services. Assignments are quoted individually based on the facts of the property and the scope of work. An engagement begins only when both you and we agree in writing on scope, fee, and timing.

Information presented on the website is not an offer, an appraisal, a valuation opinion, legal advice, tax advice, or financial advice, and should not be relied upon as such.

Professional services

Residential appraisal

Appraisal services are performed in accordance with applicable Nevada licensing requirements and the Uniform Standards of Professional Appraisal Practice (USPAP). The appraiser is engaged to provide an independent, impartial, and objective opinion of value. Our compensation is not contingent on the development or reporting of a predetermined value, a direction in value that favors the cause of the client, the amount of the value opinion, the attainment of a stipulated result, or the occurrence of a subsequent event directly related to the intended use of the appraisal. We will not accept assignment terms that require us to deliver a specific or target value.

Notary and loan signing

Notary and loan-signing services are provided through GJS Notary Services in accordance with Nevada Revised Statutes Chapter 240 and the rules of the National Notary Association. The signing agent is not an attorney and does not provide legal advice, document review, or interpretation of the documents being signed. Any questions about the substance of a document should be directed to the document preparer or to your own attorney.

Real estate and listing photography

Photography deliverables are licensed to the client for the marketing of the specific subject property identified in the engagement. The license is non-exclusive, non-transferable, and limited to that property and that marketing campaign. Resale, redistribution, sublicensing, or use in connection with a different property is not permitted without our prior written consent. We retain ownership of the underlying photographs and may use them in our portfolio.

Aerial drone operations

All aerial drone operations are conducted under FAA Part 107 commercial Remote Pilot certification, in compliance with applicable federal aviation regulations and local airspace restrictions. Flights may be limited or canceled due to weather, airspace conditions, or safety considerations.

Communications consent

By submitting a service request, you consent to receive responses by email and, if you provide a phone number, by phone call or text message regarding your request and any resulting engagement. Standard message and data rates may apply to text messages. You may withdraw consent at any time by replying STOP to a text message or by emailing us. Withdrawing consent for communications may limit our ability to respond to your request.

Intellectual property

The website’s content, design, branding, and logo are owned by GJS Appraisal Services LLC or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any portion of the website without our prior written permission, except for normal browser caching and personal, non-commercial viewing.

Third-party links and resources

The website includes links to third-party resources (such as county assessor records, mortgage rate references, and licensing-authority lookups) for convenience. We do not control and are not responsible for the content, accuracy, or availability of any third-party site. Linking does not imply endorsement.

Disclaimers

The website and all content on it are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, secure, or free of harmful components.

Limitation of liability

To the fullest extent permitted by applicable law, GJS Appraisal Services LLC and its members, officers, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the website, even if advised of the possibility of such damages. Our total aggregate liability arising out of or related to these Terms and your use of the website shall not exceed the amount actually paid by you to us, if any, for the services giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless GJS Appraisal Services LLC, its members, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of your breach of these Terms, your misuse of the website, your violation of applicable law, or your infringement of any third-party right.

Governing law and venue

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the website shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction and venue of those courts.

Attorney’s fees

In any action or proceeding to enforce or interpret these Terms, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs from the non-prevailing party, in addition to any other relief awarded.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above will reflect the most recent revision. Material changes will be effective upon posting. Your continued use of the website after a change takes effect constitutes acceptance of the updated Terms.

Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. These Terms, together with any written engagement agreement between you and us for specific services, constitute the entire agreement between you and us regarding your use of the website and supersede any prior agreements on the same subject.
